TERMS OF SALES

1. General

 

The general conditions of sale described below apply to all products and services sold only through the E-Commerce site www.pimpupandfashion.com: property of Candice Maury SARL. The products purchased on the E-Commerce site are sold directly by Candice Maury SARL (“the Seller”). They define the rights and obligations of the parties. The Seller reserves the right to modify the content and form of its general conditions of sale at any time.

2. Personal data

 

The Seller undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to process them in accordance with legal obligations.

The customer's data may be used by the Seller's internal services:

 

  • For processing orders, deliveries and invoicing
  • To inform of upcoming sales and events by sending invitation emails.
  • To strengthen and personalize communication with its customers, in particular by sending newsletters, special offers and other emails.
  • The customer is given the opportunity to refuse the sending by the Seller of invitation or commercial communication emails, upon first registration. 
  • This functionality remains modifiable in your account at any time.


The customer undertakes to provide the personal information necessary to manage their order (delivery and invoicing). These must be correct, valid and up to date.


Information relating to his identification and password must be kept secret by the customer.

 

3. Sales process

 

3.1. Orders

 

Once the desired product is selected, it is placed in the “shopping cart” using the “Add to cart” button. The customer can then continue to select items, modify their shopping cart or continue the order process and pay.

Validation of the order by the customer constitutes acceptance of the general conditions of sale.

Once the order has been validated and paid, the customer receives order confirmation information by email.

 

3.2. Price

 

The prices mentioned per item on the E-Commerce site are indicated all taxes included and excluding logistics delivery costs.

The shipping costs of the order will be indicated before the final validation of the order.


The Seller reserves the right to modify without notice and at any time the prices and other costs displayed on the E-Commerce site. However, the products will be invoiced to the customer based on the prices in effect at the time of validation of the order.


The customer benefits from the prices mentioned per item, valid in the country for which he can indicate a delivery address.
An order by the customer constitutes acceptance of the general conditions of sale.


Once the order has been validated and paid, the customer receives order confirmation information by email.

 

3.3. Product representation

 

The Seller undertakes to make the necessary efforts to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, given the way these products are presented on the Internet, it is possible that the customer's perception of the photographic representation of the products does not correspond exactly to the products themselves.

 

3.4. Secure payments

 

Payment for purchases is made using a payment card.

The payment cards accepted to date are: PayPal, Visa, MasterCard.
For customers delivered to Switzerland, payment by PostFinance is also possible.


The order will be considered effective after confirmation of the agreement of the bank payment centers.
In accordance with current regulations, and to ensure the security and confidentiality of their information, the Seller does not store the banking data of its customers.


It is therefore up to the customer to save and print their payment certificate if they wish to keep the payment details relating to their order.
Payments managed by the E-Commerce site www.mypimpup.com are subject to a security system of the highest level to date: PCI DSS level 1 certification.

This international standard, established by the main market players (MasterCard, Visa, American Express, Discover Financial Services and JCB) governs the security requirements for international payments:

  • Setting up and managing a secure network
  • Protection of cardholder data
  • Implementation of a vulnerability management program
  • Implementation of effective access control measures
  • Continuous monitoring and testing of networks at a regular frequency
  • Establishment of an information security policy

 

3.5. Associated services 

 

The products offered for sale on the E-Commerce site by the Seller may benefit from free gift packaging, associated with a free gift card with customizable message. 

The Seller reserves the right to refuse any order for products with personalization or a gift card containing terms or remarks that are inappropriate, insulting or contrary to the law.

 

3.6. Delivery

 

Shipping costs are free for all orders exceeding €250 or CHF 250, made through our e-commerce site pimpupandfashion.com and to Switzerland and all of Europe, otherwise they will be charged €12.99 / CHF.


The Seller ensures the shipping of goods sold through the E-Commerce site in Switzerland, mainland France and throughout Europe.


The products and/or services will be sent to the delivery address that the customer indicates during the ordering process.
From the time of ordering and confirmation of payment, delivery times, given as an indication, are as follows:


3 to 5 working days for Switzerland, mainland France, and Europe. These deadlines may vary by a few days depending on the carrier and global conditions and in the event of force majeure.


As soon as the order is placed and paid, the invoice will be sent by email and available on the E-Commerce site.

 

3.7. Guarantee

 

Accessories sold on the E-commerce site are guaranteed for 2 years from delivery of the product to implement the legal guarantee of conformity.

As such, he can choose between repairing or replacing the good, under the conditions provided for in article L. 211-9 of the Consumer Code. The invoice acts as a guarantee.

The warranty does not cover natural wear and tear of the product, damage caused accidentally or damage occurring during use. 

Personalized decorations are not covered by the warranty. 

If an item presents a lack of conformity, the customer can either have it repaired or replaced. If these solutions are impossible to put into practice or seem disproportionate, the customer may ask the Seller to apply an appropriate reduction on the purchase price or demand termination of the contract.

 

3.8. Returns, withdrawal and refund

From receipt of the product by the customer, he has a right of withdrawal of 14 days to return the delivered product, the return costs being his responsibility.

Only products purchased through the E-Commerce site and returned with their film or individual protective packaging intact (in their original packaging) will be eligible for a refund.

The procedure to follow is as follows:

  1. The customer connects to the E-Commerce site to request a return.
  2. The customer then sticks the return label found in the package, in place of the initial shipping label.
  3. The customer drops off the package at the nearest post office, keeping the signed proof of posting.
  4. The customer returns his merchandise at his own expense. These fees will be deducted directly from the refund amount.

The product must be complete, properly protected, in its original packaging, labels intact and attached, with the film or individual protective packaging, accompanied by all possible accessories. 
The product must be accompanied by a copy of the duly completed product sales invoice indicating the reason for the return.

The product is checked by the Seller's internal services which validate or not the reimbursement, in particular by verifying that the product has been returned complete and in a condition suitable for its re-marketing, as the right of withdrawal provides.
If the merchandise meets the return requirements, it may be subject to a refund.

If the merchandise does not meet the return requirements, it will be re-shipped to the customer who will not be able to obtain a refund.

 

3.9. Repairs

 

Repairs exclusively for the “Pimp Up tm Couture” collection and models whose price exceeds 200 CHF, the customer can contact the Seller's Customer Service by email for any request for information or repair quote concerning only products purchased through of the E-Commerce site.

By invitation from the Seller's Customer Service only, the customer will be asked to send the accessory to be repaired to the Seller at their own expense:

  • Completely: the pair and if removable parts, the entire accessory. 
  • With a copy of the purchase invoice
  • Accompanied by a descriptive text of the problem encountered
  • Accompanied by the customer's exact address for return

After examination by the Seller's Customer Service:

  1. If the repair takes more than 14 days and exceeds an amount of 40 CHF including tax, Customer Service will issue a quote.
  2. If the repair is covered by warranty, the product will automatically be repaired and returned to the customer free of charge
  3. If the repair is not covered by the warranty but does not exceed 40 CHF including tax, the product will be automatically repaired, then invoiced and returned to the customer after payment.

 Transport costs will also be billed to the customer

The repair time is announced by Customer Service on a case-by-case basis.

 

4. Applicable law

 

These general conditions of sale, as well as any sale to which they apply, are subject to Swiss law. 

Any dispute arising from or in connection with these general conditions of sale or any sale to which they apply, will be settled according to Swiss law, whether such dispute is of a contractual or tort nature, or whether it is based on another clause. 

The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

 

5. Intellectual Property

 

The structure of the site but also the texts, graphics, images, photographs, sounds, videos and computer applications that compose it are the property of the publisher and are protected as such by the laws in force regarding intellectual property.

Any representation, reproduction, adaptation or partial or total exploitation of the contents, registered trademarks and services offered by the site, by any means whatsoever, without the prior, express and written authorization of the publisher, is strictly prohibited and would be liable to constitute an infringement within the meaning of articles L. 335-2 et seq. of the Intellectual Property Code. And this, with the exception of elements expressly designated as royalty-free on the site.

Access to the site does not constitute recognition of a right and, generally speaking, does not confer any intellectual property rights relating to an element of the site, which remain the exclusive property of the publisher.

The user is prohibited from entering data on the site which would modify or be likely to modify its content or appearance.
