1. General

 

 

The general conditions of sale described below apply to all products and services sold solely through the E-Commerce site www.mypimpup.com : property of Candice Maury SARL. The products purchased on the E-Commerce site are sold directly by Candice Maury SARL ("the Seller") and define the rights and obligations of the parties. The Seller authorizes itself the right to modify at any time the content and the form of its general conditions of sale.

2. Personal data

 

The Seller undertakes to respect the confidentiality of the personal data communicated by the customers on the E-Commerce site and to treat them according to the legal obligations.

The customer's data may be used by the Seller's internal services:


To process orders, deliveries and invoices
To inform about upcoming sales and events by sending invitation emails.
To reinforce and personalize communication with the customer, in particular by sending newsletters, special offers and other emails.
The customer is given the possibility to refuse the sending of invitation emails or commercial communication by the Seller, when he first registers. 
This feature can be modified in the account at any time.


The customer agrees to provide the personal information necessary to manage his order (delivery and billing). This information must be correct, valid and up to date.

The information relating to his identification and password must be kept secret by the customer.

 

3. Sales process

 

3.1. Orders

 

Once the desired product is selected, it is placed in the "shopping cart" via the "Add to cart" button. The customer can then continue his selection of articles, modify his shopping cart or continue the process of his order and pay.

The validation of the order by the customer takes the place of acceptance of the general conditions of sale.

Once the order is validated and paid, the customer receives an order confirmation information by email.

 

3.2. Price

 

The prices mentioned by article on the E-Commerce site are indicated all inclusive of tax and except expenses of logistic routing.

The shipping costs of the order will be indicated before the final validation of the order.


The Salesman reserves the right to modify without notice and at any time the prices and other expenses posted on the E-Commerce site. However, the products will be invoiced to the customer on the basis of the prices in force at the time of the validation of the order.


The customer benefits from the prices mentioned by article, valid in the country for which it will be able to indicate an address of delivery.
An order by the customer takes the place of acceptance of the general conditions of sale.


Once the order is validated and paid, the customer receives an order confirmation information by email.

 

3.3. Product representation

 

The Seller undertakes to make the necessary efforts so that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However with regard to the mode of presentation of these products on the Internet network, it is possible that the perception by the customer of the photographic representation of the products does not correspond exactly to the products themselves.

 

3.4. Secured payments

 

The payment of purchases is made by means of a payment card.

The payment cards accepted to date are : PayPal, Visa, MasterCard.
For customers delivered in Switzerland, payment by PostFinance is also possible.


The order will be considered effective after confirmation of the agreement of the banking payment centers.
In accordance with the regulations in force, and to ensure the security and confidentiality of their information, the Seller does not store the banking data of its customers.


It is thus up to the customer to record and print his payment certificate if he wishes to keep the payment details relating to his order.
The payments managed by the E-Commerce site of www.mypimpup.com are subject to a security system of the highest level to date: PCI DSS level 1 certification.

This international standard, established by the main players in the market (MasterCard, Visa, American Express, Discover Financial Services and JCB) governs the security requirements for international payments:

Protection of cardholder data
Implementation of a vulnerability management program
Implementation of effective access control measures
Continuous monitoring and testing of networks on a regular basis
Establishment of an information security policy

 

3.5. Associated services

 

The products offered for sale on the E-Commerce site by the Seller can benefit from a free gift wrapping, associated with a free gift card with a customizable message. 

The Seller reserves the right to refuse any order of products with a personalization or a gift card containing inappropriate, insulting or illegal terms or words.

 

3.6. Shipping

 

The shipping costs are free for any order exceeding 250 € or 250 CHF, made through our e-commerce site mypimpup.com and to Switzerland and all Europe, otherwise they will be charged 12,99 € / CHF.


The Seller ensures the shipment of goods sold through the E-Commerce site in Switzerland, France and for all Europe.


The products and/or services will be sent to the delivery address that the customer will have indicated during the ordering process.
As of the order and the confirmation of the payment, the delivery times, given as an indication, are as follows


3 to 5 working days for Switzerland, France and Europe. These times may vary by a few days depending on the carrier and the world conditions and in case of force majeure.


As soon as the order is completed and paid, the invoice will be sent by email and available on the E-Commerce site.

 

3.7. Warranty

 

The accessories sold on the site E-commerce are guaranteed 2 years as from the delivery of the product to implement the legal guarantee of conformity.

As such, he can choose between repair or replacement of the good, under the conditions provided for in Article L. 211-9 of the Consumer Code. The invoice serves as a guarantee.

The warranty does not cover natural wear and tear of the product, accidental damage or damage occurring during use. 

Personalized decorations are not covered by the warranty. 

If an item is found to be defective, the customer may either have it repaired or replaced. If these remedies are impractical or seem disproportionate, the customer may request the Seller to apply an appropriate reduction to the purchase price or demand the termination of the contract.

 

3.8. Returns, retractions and refunds

 

Exchanges cannot be returned or refunded.

As from the reception of the product by the customer, this one has a right of retractation of 14 days to send back the delivered product, the expenses of return being with its load.

Only products purchased through the E-Commerce site and returned with their film or their individual protective packaging intact (in their original packaging) will be eligible for a refund.

The procedure to follow is as follows:

  1. The customer logs on to the E-Commerce site to make a return request.
  2. The customer then sticks the return label found in the package, instead of the original shipping label.
  3. The customer deposits the package in the nearest post office, keeping the signed proof of deposit.
  4. The customer returns the goods at his own expense. These costs will be deducted directly from the refund amount.

The product must be complete, properly protected, in its original packaging, with the labels intact and attached, with the film or individual protective packaging, accompanied by all possible accessories. 
The product must be accompanied by a copy of the invoice for the sale of the product, duly completed and indicating the reason for the return.

The product is checked by the Seller's internal services, which validate or not the refund, including checking that the product has been returned complete and in a condition suitable for its remarketing, as provided for in the right of withdrawal.
If the goods meet the return requirements, they will be eligible for a refund.

If the goods do not meet the return requirements, they will be shipped back to the customer who will not be entitled to a refund.

 

3.9. Repairs

 

Repairs exclusively for the "Pimp'Up Couture" collection and the models whose price exceeds 200 CHF, the customer can contact by email the Customer Service of the Seller for any request for information or estimate of repair concerning only the products bought through the E-Commerce site.

The contact of the Customer Service of the E-Commerce site for repairs is the following: aftersales@mypimpup.com

On invitation of the Customer Service of the seller only, the customer will be asked to send the accessory to be repaired to the Seller at his expense:

  • In a complete way: the pair and if removable parts, the accessory in its entirety. 
  • With a copy of the purchase invoice
  • Accompanied by a descriptive text of the problem encountered
  • Accompanied by the exact address of the customer for the return

After review by Seller's Customer Service Department:

  1. If the repair is beyond the 14 days and exceeds an amount of 40 CHF including VAT, the Customer Service will issue an estimate.
  2. If the repair is covered by the warranty, the product will automatically be repaired and returned to the customer free of charge
  3. If the repair is not covered by the warranty but does not exceed 40 CHF TTC, the product will be automatically repaired, then invoiced and returned to the customer after payment.

Transportation costs will also be charged to the customer.

The repair time is announced by the Customer Service on a case by case basis.

 

4. Applicable law

 

These terms and conditions, as well as any sale to which they apply, are governed by Swiss law. 

Any dispute arising out of or in connection with these terms and conditions of sale or any sale to which they apply shall be governed by Swiss law, whether such dispute is in contract or tort, or is based on any other provision. 

The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

 

5. Intellectual Property

 

The structure of the site but also the texts, graphics, images, photographs, sounds, videos and computer applications which compose it are the property of the editor and are protected as such by the laws in force under the intellectual property.

Any representation, reproduction, adaptation or partial or total exploitation of the contents, trademarks and services offered by the site, by any process whatsoever, without the prior, express and written authorization of the publisher, is strictly prohibited and would be likely to constitute an infringement within the meaning of articles L. 335-2 and following of the Intellectual Property Code. And this, with the exception of the elements expressly designated as free of rights on the site.

Access to the site does not constitute recognition of a right and, in general, does not confer any intellectual property right relating to an element of the site, which remain the exclusive property of the editor.

The user is prohibited from introducing data to the site that would modify or be likely to modify its content or appearance.
